Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of Eteia (the "Service"), operated by EternaLaboratory GmbH i.G. By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service. For details on how we handle your personal data, see our Privacy Policy, which forms part of these Terms.
The service
Eteia is a health-intelligence application that lets you build a personal health profile, connect wearable devices, and receive information about your own health data. The Service is informational only. It is not a medical device, and nothing in the Service constitutes medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your health.
Eligibility and your account
You must be at least 18 years old to use the Service, and we ask you to confirm this when you create your account. You're responsible for keeping your account credentials secure and for all activity that takes place under your account. The Service is intended for use within the European Union and European Economic Area.
Your responsibilities
You agree to use the Service only for lawful purposes, and not to misuse it, attempt to gain unauthorized access to any account or system, interfere with its operation, or resell, scrape, or redistribute data obtained through it.
Your data
Your use of the Service involves the processing of personal data, including health data, as described in our Privacy Policy. You can review, export, or delete your data, and manage your consent choices, at any time from your account settings.
Connected wearable providers
The Service lets you connect third-party wearable and health-data providers, such as Oura, Apple Health, Withings, Whoop, or Google Health. Connecting a provider is also governed by that provider's own terms and privacy policy, which you should review separately. Data made available by a connected provider is provided "as is"; to the fullest extent permitted by law, we and our connected providers disclaim all warranties in respect of that data. If you disconnect a provider, or request deletion of that provider's data, it will be deleted within 72 hours.
AI-generated content
The Service may use artificial intelligence and machine-learning technology to process information you provide and to generate certain outputs, such as extracted document facts or conversational responses. These outputs are generated automatically and may be incomplete or inaccurate. They are informational only, are never a medical diagnosis or treatment recommendation, and are never a substitute for professional medical judgment.
Intellectual property
The Service, including its content, features, and underlying technology, is owned by Eteia and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use, subject to these Terms.
Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any information it provides is complete or accurate.
Limitation of liability
To the fullest extent permitted by law, Eteia will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Service.
Governing law, changes, and contact
These Terms are governed by the laws of Germany and the European Union, without regard to conflict-of-law principles. Any disputes arising from these Terms are subject to the exclusive jurisdiction of the courts of Munich, Germany, to the extent permitted by applicable consumer-protection law. We may update these Terms from time to time; when we make material changes, we'll update the effective date above and notify you in the app. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
